This article is all about the incident which happened to the women aspirants going for the NEET (National Eligibility Cum Entrance Test) UG (undergraduate) examination center. NEET exam held on Sunday (17-07-2022).
Students were appearing for NEET UG in Kerala, Kollam
district they were forced to remove their innerwear before entering an
examination hall. This incident took place at the Mar Thoma Institute of
Information and Technology at Ayur.
This event turned into a horrific nightmare for the
medical aspirants as they were particularly forced to either leave the
examination hall or remove their innerwear as they go through a metal detector
which obviously beeped and unfortunately these women found themselves in a horror
bull situation where they have to take the exams in order to have agreed what
they had to do what they were asked to do.
this case was highlighted when a girl's father complained
to the Kollam Rural Superintendent of Police K B Ravi after the NEET exam was
held on Sunday, seeking a probe into the alleged incident.
In the complaint, the father alleged that many students who
attended the exam were forced to remove their innerwear although this is not a
requirement under norms mandated by the National Testing Agency (NTA), which conducts
the NEET examination.
Guidelines provided by the NTA for NEET UG, 2022: -
NTA has issued guidelines for the exam that will be
conducted Sunday and also provide a dress code.
Students must follow Covid’s advisory for the NEET UG
2022 examination.
Candidates should maintain social distancing and use the N-95
mask being provided at the center.
In case a candidate reaches the examination in
cultural/traditional or customary dress they should report at least an hour
before the last reporting time.
Frisking of the female candidates will be done inside a closed enclosure by female staff only.
NEET UG, 2022 Dress Code: -
1) Light clothes with long sleeves are not permitted.
2) Slippers and sandals with low heels are permitted.
shoes are not permitted.
3) items like wallets, goggles, belts, and caps are prohibited.
4) Watches, wristwatches, bracelets, cameras, ornaments,
and metallic items are also prohibited.
5) candidates are not allowed to carry any personal belongings including electronic devices, mobile phones, and other banned/prohibited items.
Legal Aspect of this incident: -
The case was registered under Section 354 (assault or
criminal force to a woman with intent to outrage her modesty) and Section 509 (uttering
any word or making gestures intended to insult the modesty of women) of the
Indian Penal Code (IPC). These two sections are dealing with the crime against
women where the accused intentionally does such an act that harms the women
mentally as well as physically. This section explicitly provides that the
person offended should be a woman of any age.
In the landmark case of State of Punjab v. Major Singh,
where SC laid down the test of determining the outrage in respect of the
prudence of a reasonable man. if such a man thinks that the act committed is
sufficient to outrage the modesty of women then such an act would attract the impugned
provision (Section-354).
In the case of Rupan Deol Bajaj v. K.P.S. Gill (1995),
the act by the accused of slapping the posterior of a lady I.A.S., Officer in
the presence of a gathering comprising the elite of the society when considered
in the light of the sequence of events involving overtures, words used and
gestures made prima facie amounted to the commission of an offense under
Section-509, IPC by the accused.
